This website is operated by ZONA SHOPPERS LLC. Throughout the site, the terms “we”, “us” and “our” refer to ZONA SHOPPERS. ZONA SHOPPERS offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”, “Services”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you should not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our site is hosted on wpengine and aws. It provides us with online e-commerce hosting that allows us to sell products and services to you. They are a third party and as such, we are not responsible for any inconvenience, misuse, misrepresentation, or intention done by them. We are following all protocols advised by them to protect our platform. Any cyber-attack through hosting does not constitute a wrongful action from Zona Shoppers, as such, we cannot be directly accused or sued for such actions.  

Acceptance of Terms

This document and other documents presented on this, and other pages of the Zona Shoppers LLC site will be of reference for our Terms of Use (identify by the short “Terms”) of our company. The Terms are a legally binding contract between the buyer (you), the vendor, and Zona Shoppers. If you are a buyer from outside of the United States, Central or South America you are also legally binding to the contract with Zona Shoppers with headquarters in Florida, US.   

Zona Shoppers is a site that provides a Service to an unlimited amount of people around the world, either online or/and offline. The main purpose of Zona Shoppers is to provide a venue where people can sell or buy products.  As so, it is important for you to get acquainted with the use of our Services through guides provided to you via the Terms of Use, Buyer’s Policy, Vendor’s Policy, and Third Parties’ Policy. This information is important for you to read and understand because forms part of the Terms of Use and as so, they must be followed, respected, and applied during the use of our Services. 

Please be advised that in this Terms you will find Section Disputes with Zona Shoppers, which refers to any Disputes between the buyer and Zona Shoppers. This section contains an arbitration clause and class action waiver.  By agreeing to the Terms, you are agreeing to Section Disputes with Zona Shoppers to resolve all disputes through binding individual arbitration, which means that you waive any right to have any dispute being decided by a judge, court judge, or court of law.  You also waive any right to participate in class actions, class arbitrations, or representative actions.

This is a legal contract that sets out your rights and responsibilities when you use Zona Shoppers.com or any other service provided by Zona Shoppers.com,  Zona Shoppers LLC, or vendors (collectively known as “Services”) so it is encouraged for every person in the use of our Services to read to the Terms before committing to them.  If you feel you are not in agreement with one or any of our Terms this action will immediately lead to conclude the use of our Services.   This Terms of Use applies to everyone no matter race, color, religion, location, or any other circumstance that you may think does not apply.      

Privacy Policy

When you utilize our services, you are trusting us with your private information. We take this matter very seriously and it is our responsibility to work hard to protect your information and give you control over it. Zona Shoppers Privacy Policy is meant to help you understand the type of information we collected, the reason why we collect that information, and how you can update, manage, and delete your information.  It is important for you to read our Privacy Policy in detail. By accepting the Terms of Use, you agree with Zona Shopper’s Privacy Policy and the use of your information to provide better service to our customers.  Zona Shoppers and vendors will be processing the information you provide but these are two different entities and as such, are considered independent data controllers of buyers’ information according to the regulation of the U.S & EU. This means that each entity is responsible for the information collected and the process use to provide the services.  Mistakes are done by a vendor during a service (selling, buying, or any transaction between vendor and client) or sharing information in mistaking transactions or other issues is not a responsibility of Zona Shoppers and affiliates, and Zona Shoppers will not be penalized for such actions.  Zona Shoppers is not responsible for the disclosure of information done by vendors and by accepting the Terms of Use you are accepting that any violation of your information should be taken as a mistake done by vendors and not by Zona Shoppers. If, however, Zona Shoppers and vendors are found to have joint control of personal data, and under such or other circumstances related to the management of your private information, you (the user of  Zona Shoppers Services) decided to continue legal litigation, you (the buyer or user of Zona Shoppers Services) will be responsible for the fines, indemnification, and payments in full of all expenses incur provided the innocence of Zona Shoppers as establish in Section   Indemnification. 

  Private Accounts

To use our Service, it is necessary for you to open an account in Zona Shoppers (the “Site”).   It is necessary for you to comply with the following information:

    1. You must be 18 years or older to use our Services. Minors between 17-year-old or younger at the time of opening an account need to use the account of a parent or guardian with the appropriate previous permission and direct supervision. Zona Shoppers, vendors, and all related personnel are not responsible for purchases made by minor/s and must not be held accountable for such act/s.  The guardian or parent is the person to be responsible for the acts of a minor in the Site or Services. If a minor wishes to sell products on the Site, it must be done through a guardian, supervisor, adult, or parent’s account.  The USA laws prohibit a minor to conduct business, only through a legal guardian or parent. Please this information under Minor’s Policy.
    2. To keep a cordial and legal relationship it is necessary to provide accurate and reliable information. By providing accurate information you are allowing us to provide you with excellent Services.  Accurate information includes, but not only, current mailing address, current phone number, current payment/s method/s, and all the required information by vendors. The information provided must be corroborated to process payment.  If the information provided is not the one used to process a payment further information must be provided to receive the Services.  Please review the Payment Policies to learn more about them.  Providing false information or other people’s information is punishable by law and if found guilty you are responsible for all the legal indemnification of Zona Shoppers, vendors, and personnel. Organizations, Private Entities, or Governmental Agencies are welcome to open an account in Zona Shoppers.  To open an account as an Organization, Private Entity or Governmental Agency is important to provide the necessary documentation to prove such entity, organization, or agency and the person in charge of the account.
    3. To provide you with great Services your account should have a unique name and unique password. A unique name and password decrease the chances of misleading services.  The name and password you have chosen to use are your responsibility and discretion must be applied when using it.  Zona Shoppers, vendors, or employees are not and will not offer, suggest, or provide the buyer with names or passwords for the buyer’s accounts.  If you decide to use a unique name is up to you to select the type of name you will use. If you don’t remember the name used or the password, we recommend selecting another name or password to receive Services. 
    4. The actions done in your account are solely your responsibility. We do not have access to any account password or username even when it is on Zona Shoppers.  You need to keep track of all transaction/s done under your account.  If you notice any irregular transaction/s, please do not hesitate in contacting us immediately to proceed with an investigation.  If the account is being used by multiple people, it is the person who opens the account and the one solely responsible for the actions of others with access to the account.  The actions include but are not limited to financial information, personal information, delivery information, and any other information necessary to provide the Services.  Once you agree to the Terms of Use you agree to be responsible for any action, or financial misleading in your account provoked by people with access to your account.  If there is any change to your account, it is necessary for the person in charge of the account to approve such changes.   

The Zona Shoppers accounts are not transferable, meaning you cannot give your account to anyone else for their personal use. Ultimately the person who opened the account is totally responsible for the management of the account including the finance. 

    1. We are always encouraging people to maintain vigilance over their accounts and the transactions done in them. Nowadays electronic accounts are becoming the target of cyber-attacks. Here at Zona Shoppers, the security of our clients is extremely important to us.  We maintain high levels of security. Also, we provide a Fraud Filter to minimize, if not eradicate cyber-attacks. You also need to do your part, by keeping your password and name protected.  Please read How to Keep My Account Safe for further information regarding your account.  Remember, after all, your financial information is extremely valuable and your need to protect it.
    2. Buyers are not employees of Zona Shoppers even under the Affiliate Program or Spread the Voice. Zona Shoppers employees are governed by a legal contract between the company and the individuals.  The Affiliate Program or Spread the Voice does not fall under this category and therefore does not constitute a company-employee contract. 

Closing of a Private Accounts/ Changes to the Account

Closing of a Private Account means when you decided no longer to have an account in Zona Shoppers and make the conscious decision to close the account. Closing your account will not affect the ability to see all the content in Zona Shoppers, but it will affect other aspects such as:  

    1. You will not have access to your log-in.
    2. You will not be able to pay automatically
    3. You will not have access to digital content from vendors
    4. You will not have access to your purchasing history
    5. You will not have access to refunds and returns processes
    6. You will not have access to use your gift cards
    7. You will have access only to look at the content.

Content

Content refers to everything you post on the Site.  If at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or another personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

Licenses and Access to Services

    1. Zona Shoppers or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Zona Shoppers Services. This license does not give you any right to resale or commercial use of any of Zona Shoppers Services, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Zona Shoppers Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Use, or any Service Terms are reserved and retained by Zona Shoppers or its licensors, suppliers, publishers, rightsholders, or other content providers.
    2. Anyone under any circumstance is to use, duplicate, copy, sold, resold, reproduce, visit, or exploited any of Zona Shoppers Services for any commercial use other than the one used by Zona Shoppers.
    3. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Zona Shoppers or any of its vendors, without express written consent. You may not use any meta tags or any other “hidden text” utilizing Zona Shoppers’ name or trademarks without the express written consent of Zona Shoppers. You may not misuse the Zona Shoppers Services for any illegal activity.  You may use the Zona Shoppers Services only as permitted by law and Zona Shoppers LLC. The licenses granted by Zona Shoppers terminate if you do not comply with these Terms of Use or any Service Terms.

Disclaimer of Warranties and Limitation of Liability

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as “available” for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall ZONA SHOPPERS, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification  

Indemnification is the compensation for harm or loss.  You agree to indemnify, defend and hold harmless ZONA SHOPPERS and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Use or the documents they incorporate by reference or your violation of any law or the rights of a third-party. In other words, if any person using the Services of Zona Shoppers causes either voluntarily or involuntarily damage or we get sued for any Intellectual Property Infringement or any other act that results in a lawsuit against Zona Shoppers, the person responsible or the people responsible for such act will have to pay an indemnification to Zona Shoppers. Yet more, the person responsible for causing damage/s to Zona Shoppers, its vendors, or personnel, will oversee paying the defense of Zona Shoppers, its vendors, staff, third parties, and any other person affected by such acts, in addition to all the extra expenses incurred as consequences, such as attorney’s fees or court’s fees. If there is a breach of the Terms of Use or your actions or account cause an infringement you are responsible for the consequences of your actions.  We have the right to select the defense attorney that better suits Zona Shoppers and our vendors and/or employees.  

  Disputes with Vendors and/ or Zona Shoppers

If you find yourself in a dispute with any of Zona Shoppers’ vendors or a third party, we encourage you to try to resolve the dispute amicably. But sometimes we understand things are not easy and that communication could be a complicated pathway.  Here at Zona Shoppers, we want you to buy with confidence. However, disputes between buyers and vendors (merchants) will occasionally occur. When this happens buyers should first contact vendors directly to try to find a solution. If the parties cannot resolve their dispute the Zona Shoppers Dispute Program provides a mechanism to address the buyer’s complaint.

The Zona Shoppers Product Solution Guarantee applies to qualified purchases of physical goods. The condition of the item you buy is guaranteed under the Zona Shoppers Customer’s Purchase Protection. For transactions that are not covered by the Zona Shoppers Customer’s Purchase Protection, the Zona Shoppers Dispute Program(below) still allows buyers to obtain our assistance in seeking the vendor’s further consideration. Zona Shoppers Payment third-party services do not act as the agent of either party in any transaction or in resolving any dispute. Zona Shoppers Dispute Program will attempt to resolve disputes by fostering good faith communication between buyers and vendors.

Zona Shoppers Product Solution Guarantee (aka Customer’s Purchase Protection)

Zona Shoppers Product Solution Guarantee applies to qualified purchases of physical goods. The product you bought on Zona Shoppers.com is guaranteed under the Zona Shoppers Product Solution Guarantee. There is a list of products not covered under the Zona Shoppers Product Solution Guarantee (Prohibited Products). It is important to mention that Zona Shoppers does not act as the agent of either party in any transaction or in resolving any dispute, we collect the evidence from both parties. We will attempt to resolve disputes by fostering good faith communication between buyers and merchants.

Your products are covered under Zona Shoppers Product Solution Guarantee if:  

  •  
    •  Bought by mistake
    • Not as described
    • Wrong product shipped
    • Change of mind
    • The product is defective, broken, or does not work
    • The product or shipping container is broken
    • Product damage but shipping container in right conditions
    • Product not delivered
    • Product is incomplete, missing part, or broken part
    • I did not make the purchase

The Product Solution Guarantee, also known as Customer Purchase Protection will not qualify if:

  •  
    • The product was never pick-up at the location or rejected upon delivery
    • Product damaged by the freight company
    • Digital content, some equipment (review vendor’s policy)
    • Remorse Purchase
    • Item is damaged at the pick-up location
    • Items redirected to a different address other than the one given to the vendor
    • Opened sealed packages
    • Products without manufacturer’s tags
    • Used items
    • Items different from those sent by vendors
    • Late returns
    • Damage or stain items
    • Items purchased and paid outside of the platform
    • Purchases are done using stolen accounts or payment methods
    • Illegal products from the Prohibited Products list
    • Counterfeited items
    • Any other act that goes against any of Zona Shoppers’ policies

Buyers on some occasions should wait 24 business days for the delivery of tangible items if the item is from overseas, 7 days for locally delivered items or services, and one business day for the delivery of digital items before filing a complaint. However, a complaint needs to be submitted within 30 days of making payment. If a vendor has clearly misrepresented the condition or details of an item in a way that affects its value or utility, it is “materially different” and that vendor should be willing to offer a refund or exchange within 30 days of shipment. If the vendor does not accept the return of an item that is made in accordance with the vendor’s return policy, you may qualify for coverage under the Zona Shoppers Product Solution Guarantee.

When is a product “Materially Different” from the way a merchant described it?

Items are considered “materially different” in these circumstances:

  •  
    • Wrong version or edition
    • Item condition or details not as described
    • Wrong item
    • Missing parts or components
    • Defective item
    • Damaged item

When submitting a claim with the reason “materially different,” you will need to select one of the reasons above and provide comments explaining why the item you received is materially different from the item you purchased. Please note that this does not extend to cases where you are simply disappointed with an item. We will ultimately determine material differences at our discretion.

This guarantee applies only to the purchase of physical goods. Therefore, the following items are not covered by the Zona Shoppers Product Solution Guarantee: payments for services, payments made via the Send Money or Request Money features (Person-to-Person or P2P payments), digital merchandise, cash equivalent instruments (including retail gift cards), and prohibited items (including items violating the Zona Shoppers Product Solution Guarantee). You may still seek our assistance in resolving disputes for these items by submitting a dispute.

The Zona Shoppers Product Solution Guarantee does not apply to unlawful or prohibited items.

Prohibited Items and Activities:

  •  
    • Adult Oriented Products and Services — includes general pornography (including child pornography), sexually explicit materials (in all media types such as the Internet, phone, and printed materials), dating services, escort services, or prostitution services.
    • Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs—Alcohol (includes sales of beer, and liquor conducted over the Internet or mail order) and drugs are prohibited on Zona Shoppers. These substances face serious legal restrictions and in many cases are considered controlled substances under applicable law. Our policy also applies to other substances that have or are claimed to have an intoxicating or healing effect.
    • Animals or Animal Parts, Including Human Remains — pets and live animals are prohibited from being sold on Zona Shoppers. Items created using any endangered or threatened animal species. We define these as animal species designated as threatened or endangered by the US Endangered Species Act or listed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
    • Items made from cat and dog parts, or pelts as defined by US Federal Law.
    • Ivory or bones from ivory-producing animals, including tusks, elk ivory, fossilized ivory, and wooly mammoth ivory.
    • Items made from human remains or products from the human body, except for teeth, fingernails, and hair.
    • Items like Non-Ivory Animal Bones and Antlers, Leather Goods, Textiles Made from Animal Hair, Human Teeth or Hair,
    • Artifacts and Cave Formations — Items obtained from government or protected land, historical gravesites, or shipwrecks, can’t be sold on Zona Shoppers
    • Cash or cash equivalent instruments — including but not limited to money orders, travelers’ checks, and generally accepted stored value products.
    • Collection Agencies — includes businesses that are engaged in the collection of uncollectible debt or accounts receivable and billing companies.
    • Credit Services — includes credit counseling, credit repair services, credit protection, and identity theft protection.
    • Crowdfunding or any activity related to soliciting contributions, donations, investments, or pre-orders to fund the development of a product or a project.
    • Donations and Charitable Solicitations — includes charities and non-profit organizations without a valid 501(c)(3) tax-exempt status, charitable solicitations, commercial fundraisers (including commercial co-ventures), or any activity associated with the solicitation of donations.
    • Drugs, Drug Paraphernalia, and Dietary Supplements — includes illegal drugs, drug paraphernalia, online or mail-order pharmacies, importation of pharmaceuticals from foreign countries, and prescription devices. Marijuana and Cannabidiol (CBD) products are also prohibited, regardless of whether legal within a given state. Guidelines and restrictions set forth on Zona Shoppers’ Restricted & Prohibited Products pages for Drugs & Drug Paraphernalia and Dietary Supplements also apply.
    • Financial Intermediaries and Money Service Businesses — includes online auctions, Internet malls processing third party payments, credit card aggregators, offshore banking operations, debt financing, money transmitters, check cashing services, currency exchange and dealing, cash advance services, payday lending, escrow services, any service that receives and processes money on behalf of others, and any issuers, redeemers, and sellers of money orders, traveler’s checks, and stored value products (other than retail gift cards).
    • Firearms and Weapons — includes ammunition, guns, rifles, shotguns, pistols, other firearms, knives (automatic, spring-loaded knives, throwing, etc.), brass knuckles, or other weapons.
    • Gambling Businesses — includes online gambling (including poker), lotteries (including the sale of lottery tickets), games of chance (including sweepstakes and raffles), sports forecasting, or odds-making.
    • Healthcare Discount Plans — includes discount healthcare plans or membership programs.
    • Illegal, Inappropriate, or Offensive Items or Activities — includes any good or service that violates local, state, or federal laws or regulations or that would be generally offensive to others. Examples include stolen goods, Cuban cigars, cable descramblers, materials that infringe other’s intellectual property rights (including pirated software and counterfeit goods), human body parts, endangered species, items that defame or slander others, hate literature, occult materials, and any other items or activities that in our judgment are illegal, inappropriate, or offensive in connection with our services.
    • Marketing Businesses — includes direct marketing, subscription merchants, telemarketing, multi-level marketing, “up-sell” merchants, infomercial merchants, and rebate-based businesses.
    • Membership Clubs — includes buyer clubs, membership clubs, and lifetime memberships or guarantees.
    • Miracle Cure Products — includes cures, remedies or enhancement products, and other health/nutritional products offering guaranteed results.
    • Money Making (“Get Rich”) Businesses — includes information guides, warranty fees, mortgage reduction services, and any product or service where a prize is guaranteed, marketing media is unavailable, premiums/incentives are offered, promises of future guaranteed results are made, or any rebate or reward program is.
    • Phone Services — includes 800 or 900 phone services and audio text services, prepaid phone cards, and prepaid phone services.
    • Real or replica government, law enforcement, security, military or paramilitary badges and uniforms, identification documents, birth certificates, passports, licenses, patches, collars, or tags.
    • Regulated Activities — includes regulated investment services, bail bonds services, security brokers, bankruptcy attorneys, real property and real estate (including rental payment), property management, and websites or online services directed to or that collect personal information from children under 13 years of age.
    • Remote Technical Support, or any other activity where a merchant needs remote access to a buyer’s computer or other devices to initiate or complete a purchase, or to provide the service being paid for.
    • Smoking/Tobacco Products — includes cigars, cigarettes, e-cigarettes, and other tobacco products. E-liquid products for use in smoking devices are also prohibited, whether they contain nicotine or not.
    • Travel and Time Share Services — includes agencies, tour operators, clubs, packages, airlines, cruise lines, and timeshares.

The Time to Make a Complaint

For purchases of physical goods under the Zona Shoppers Product Solution Guarantee using Zona Shoppers Payment, we suggest between 7 days to a maximum of 30 days after the delivery of the product. Ultimately the vendor is who decides how many days you have to make a complaint. They rule over their complaint time and policies.  

Requirement for a Complaints

Each of the following requirements must be met to submit a complaint:

  •  
    • The claim must be timely filed.
    • If you have received a materially different item, you must contact the merchant within seven (7) days of receipt to request return information or the time determined by the vendor which should not be less than 7 days after delivery.
    • If your item becomes defective more than 30 days past the shipment date and it is under warranty, you must contact the vendor and/or the manufacturer for repair or replacement.
    • You must provide the required information on the claim form.
    • If you paid by credit card and the issuing bank initiated a chargeback, you are not eligible for coverage.

How Much I am Cover For?

If you follow all the rules and indications made by the vendor and/or Zona Shoppers and you make an on-time claim you are entitled to receive 100% reimbursement of the price, except the shipping charges.  If the item is not in the same conditions or any change has been done to the product, if the product loses its tags or suffers any damage or if you send the wrong item, the vendor has the right to impose a Restocking Fee, which can go from 10% to 20% of the cost of the product. For products that have been changed or broken the vendor has the right to charge a Damage Fee of up to 50% of the sale price.   

How to submit a complaint?

Zona Shoppers Dispute Program

In Zona Shoppers, we appreciate you doing business with us.  We understand we live in a complicated and broad world, where words may have a different perspective.  If you find yourself in a disagreement with any of our vendors or third-party suppliers, you should first contact them to try to alleviate and resolve the situation.  If you have done everything you could to try to resolve the situation and still cannot find the resolution you are looking for, then we will try our best to resolve the issue.  Zona Shoppers Dispute Program will attempt to resolve any disputes by fostering good faith communication between buyers and vendors. It is important to understand that each vendor has its own rules regarding the return or the handling of items.  If all the rules were followed and all the items were handled in the proper way, then we understand you follow the rules, and the communication should be favorable toward both parties. We take pride in keeping a safe, amicable, and satisfying environment for all parts.

 Disputing with Zona Shoppers

In the case of a dispute between an individual and Zona Shoppers, the following rules are used as guidelines

    1. Governing Law. The Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live, but if you live outside of the United States, you may be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.
    2. Arbitration. You and Zona Shoppers agree that any dispute or claim arising from or relating to the Terms shall be finally settled by final and binding arbitration, using the English language, administered by the American Arbitration Association (the “AAA”) under its Consumer Arbitration Rules (the “AAA Rules”) then in effect (those rules are deemed to be incorporated by reference into this section, and as of the date of these Terms you can find the AAA Rules here) unless otherwise required by law. Arbitration, including threshold questions of arbitrability of the dispute, will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis — class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and Zona Shoppers are each waiving the right to trial by jury or to participate in a class action or class arbitration. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis.
    3. Costs of Arbitration. Payment for any and all reasonable AAA filing, administrative, and arbitrator fees will be in accordance with the Consumer Arbitration Rules. If the value of your claim does not exceed $10,000 USD, Zona Shoppers will pay for the reasonable filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose.
    4. Forum. We’re based in Florida, so any legal action against Zona Shoppers related to our Services must be filed and take place in Osceola County, Florida. For all actions under the AAA Rules, the proceedings may be filed where your residence is, or in Florida, and any in-person hearings will be conducted at a location that is reasonably convenient to both parties considering their ability to travel and other pertinent circumstances. For any actions not subject to arbitration, you and Zona Shoppers agree to submit to the personal jurisdiction of a state or federal court located in Osceola County, Florida if your contract is with Zona Shoppers LLC.
    5. Government Exception. If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Florida.
    6. Modifications. If we make any changes to this “Disputes with Zona Shoppers” section after the date you last accepted the Terms, those changes will not apply to any claims filed in a legal proceeding against Zona Shoppers prior to the date the changes became effective. Zona Shoppers will notify you of substantive changes to the “Disputes with Zona Shoppers” section at least 30 days prior to the date the change will become effective. If you do not agree to the modified terms, you may send Zona Shoppers a written notification (including email) or close your account within those 30 days. By rejecting a modified term or permanently closing your account, you agree to arbitrate any disputes between you and Zona Shoppers in accordance with the provisions of this “Disputes with Zona Shoppers” section as of the date you last accepted the Terms, including any changes made to prior to your rejection. If you reopen your closed account or create a new account, you agree to be bound by the current version of the Terms.

Changes to the Terms

We may update these Terms from time to time. If we believe that the changes are material, we’ll let you know by posting the changes through the Services and/or sending you an email or message about the changes. That way, you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes unless otherwise specified. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

Product Description

Zona Shoppers attempts to be as accurate as possible. However, Zona Shoppers does not warrant that the product description or other content of any Zona Shoppers Service is accurate, complete, reliable, current, or error-free. If a product offered by Zona Shoppers itself is not as described, your sole remedy is to return it in unused condition as delivered.

Pricing

We work hard to maintain accurate and up-to-date information when describing and pricing the products.  If there is a difference or mismatch in price, we need to make the necessary corrections to sell the product at the right price.  This means that even after you have selected the product for purchase, Zona Shoppers has the right to set the correct price without this being a reason for conflict between the buyer and Zona Shoppers

 We generally do not charge your credit card until after your order has entered the shipping process or, for digital products, until we make the digital product available to you.

Intellectual Property Complaints 

Zona Shoppers respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please do not hesitate in making a complaint at zonashoppers@zonashoppers.com

Risk of Loss

All purchases of physical items from Zona Shoppers are made pursuant to a shipment contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier.

Returns, Refunds, and Tittle

Zona Shoppers does not take title to returned items, but to the vendor’s fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Zona Shoppers does not take title to the refunded item.  To obtain a prompt refund it is necessary to send the product through a secure shipping company.  It is also highly recommended to insure the shipment. Also, we expect the product to be in the exact conditions that were sent to the destination. 

Return-less Policy

Return-less Policy is to provide outstanding service to the customers. You can use this statement: “If, for any reason, you are not satisfied with your purchase, we offer a return-less policy with a store credit option. The Return-less is when the customer keeps the product, regardless of the situation, and the seller provides a store credit.” (please do not include the “”)

Return-less Policy outlines the conditions for returning products and getting store credit in return, with certain limitations and exceptions. This policy only applies to those vendors offering Return-less as their return option. They can combine regular returns with return-less, but it needs to be specified per product.

Returns Rule 

These Basic Rules Must for Part of the Vendor Return-less Policy:

  • You may request a return-less for up to 7 products per year, regardless of the number of vendors you purchased from. 
  • The request for a return-less must be made within 365 days of the purchase date.
  • The vendor can charge a reasonable shipping cost which is deducted from the store credit. 
  • You will receive a full refund for the purchase using your credit cards, PayPal, Stripe, or any other payment gateway offered by Zona Shoppers. 
  • After receiving your request, we will issue a store credit that can be used for future purchases.
  • Purchases done using store credit are considered final sales. This prevents scams from abusing the platform and the service. 
  • You receive a store credit for out-of-pocket money used to pay for a difference between store credit and product price. (explained below)
  • Store credit is valid for 365 days in most states, except in Hawaii, which lasts 2 years from the date of issue. After that, it will be canceled and cannot be used.

 Shipping Charges:

  •  Shipping charges may apply for returns at the vendor’s sole discretion.

Eligibility: 

  •  The vendor will specify which products or if all products will fall under the return-less policy. Some products may be excluded due to hygiene or safety reasons. The customer can assume that all products fall under the return-less policy if the eligibility is not stated.

To provide clarity on eligibility criteria in the returnless policy, the vendor should include the following points:

  1. Eligible products: The policy should specify which products are eligible for the return-less process. This may include all products, specific categories of products, or exclude certain products due to safety or hygiene reasons.
  2. Eligibility timeframe: The policy should clearly state when customers can initiate a return-less request.
  3. Product condition: The vendor’s policy should specify what to do if there is a discrepancy in the product and description, state, or functionality. 
  4. Valid reasons for return: The policy should list the right reasons for a returnless request, such as incorrect product received, product not as described, or defective product. This is an option the vendor can use to elevate customer service. 
  5. Exclusions: The policy should mention any exclusions or limitations that apply, such as products sold on clearance or final sale items.

Maximum Returns: 

  • We offer a maximum of 7 product returns using return-less. 
  • This rule should be avoided for loyal customers. You should develop a statement here about how to become a loyal customer. For example, to become a loyal customer, they must purchase at least 10 (ten) consecutive products without requesting a return. The vendor has the alternative of adding a loyal customer to their list on the dashboard.  

Timeframe:

Store credit is valid for 365 days in most states, except in Hawaii, which lasts 2 years from the date of issue. After the offered time, it will be canceled and cannot be used.

Please allow the vendor 24-48 hours to review your account and process the returnless. If 48 passes and the vendor doesn’t respond, the Zona Shoppers team will assign a store credit regardless of the return type. 

  

 Reason for Return-less Request:  

The vendor may need to know the reason for the returnless request to improve future products and services. Therefore, please cooperate and provide the reason for the returnless request.

Return-less Refund Process

The vendor must add the process to request a refund. For example, the process for initiating a return-less refund is simple. Just visit your account (My Account) located on the homepage and select the product you wish to return. Then, contact the part of the vendor related to the product, and request a refund. In most cases, the return-less request is accepted immediately, but the vendor may need to review the account or be out of the customer’s reach. So please, if 48 hours have passed and you are still waiting for a response, contact us at customers@zonashoppers.com to process your store credit for the pertained amount.

Exceptions:  

Each vendor may include exceptions to this policy at their discretion, but the basic rules will prevail. Some examples of exceptions are stopping a return if the customers have already used all 7 requests, explaining that products purchased using store credit are final sales, etc. 

Fraud Prevention: 

We take fraud prevention very seriously to protect our business and customers. To prevent fraudulent or unauthorized charges, we may use various security measures, including but not limited to the following:

1. Authentication: We may use various authentication methods to verify the identity of the person making a return-less request. This may include requesting additional information or documentation, such as order confirmation emails, receipts, or ID verification.

2. Monitoring: We monitor all return-less requests and payment transactions for suspicious activity. We use fraud detection software and work with payment processors to identify and prevent fraudulent transactions.

3. Investigation: If we suspect fraudulent activity, we will conduct a thorough investigation to determine the validity of the request. We may contact the customer and/or the payment card issuer to verify the transaction details.

4. Blocklisting: We reserve the right to blocklist customers who attempt to make fraudulent or unauthorized returns. Customers who are blocklisted will no longer be able to make purchases or returns on our website.

Store Credit Limitation:  

  • When you make a purchase using store credit, you’ll receive a credit in the amount of the item(s) returned. If you use that credit to make a new purchase and the price of the item(s) is less than the amount of your credit, the remaining credit will be held in your account for future use. However, if the price of the new item(s) exceeds the amount of your credit, you’ll be required to pay the difference out of pocket
  • The out-of-pocket difference will be considered a new purchase and will be covered by Return-less. So, the customer can have a store credit for the out-of-pocket amount. 
    • For example, Suppose the customer purchases a $100 item using store credit and the new purchase totals $120, making a difference out-of-pocket of $20. In that case, your new applicable amount for store credit will be $20. The customer can request a partial store credit for the out-of-pocket payment. 

However, a vendor can block a customer from requesting a return-less on items purchased with your store credit; it will be considered a final sale. For example, if a customer bought a $100 item (new item) using store credit and later attempted to return it, the item cannot be returned under any circumstances. If the item is broken or not working, then the vendor must offer an alternative, for example, sending pictures declaring the problem. The customer can have a number of days from delivery to request a return if an item is broken or not working. 

Unfortunately, some people take advantage of such an excellent policy, and we need to come up with ways to avoid scammers.  

If the customer buys an item using a credit card or other payment method, that product is considered a new purchase, and the vendor offering Return-less must offer store credit. The out-of-pocket amounts are also considered new purchases and requested as partial store credit. 

Please note that if there is a change in this Return-less Policy, the vendors will be notified. As well, if the vendors make changes, it cannot affect previous sales.

When you use Zona Shoppers Services or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Zona Shoppers Services, such as our Message Center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Some Finer Legal Points

The Terms, including all the policies that make up the Terms, supersede any other agreement between you and Zona Shoppers regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

 Applicable Law

By using any Zona Shoppers Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Florida, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Zona Shoppers.

Site Policies, Modification, and Severability

Please review our other policies, such as our Pricing Policy (below), posted on this site. These policies also govern your use of Zona Shoppers Services. We reserve the right to make changes to our site, policies, Service Terms, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

About Price Matching: Zona Shoppers.com consistently works toward maintaining competitive prices on everything we carry so Zona Shoppers.com doesn’t offer price matching.

About List Prices: “List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller.  We regularly check List Prices against prices recently found on Zona Shoppers.com and other retailers.  Certain products may have a “Was Price” displayed, which is determined using the recent price history of the product on Zona Shoppers.com.

About Shopping Cart Prices: Items in your Shopping Cart will always reflect the most recent price displayed on the item’s product detail page. This price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart doesn’t reserve the price shown at that time. It is also possible that an item’s price may decrease or increase between the time you place it in your cart and the time you purchase it.

Note: You’re not charged until after your order has entered the shipping process.

If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. This applies only to products sold and shipped on Zona Shoppers.com. Vendors may follow different policies in the event of a mispriced item.

About Surcharges: Oversized and extremely heavy items will incur a special shipping surcharge.  The surcharge varies depending on the size and weight of the item. This charge will be displayed in the Shipping & Handling subtotal of the order form.  Some items may incur a sourcing fee to cover the expense of selling these items; we regret that we must occasionally pass these costs along to our customers. The sourcing fee, if applicable, will be listed along with the item’s price on the product detail page.

About Promotional Pricing: Sometimes when vendors low their prices as part of a promotion, other retailers will decrease their own prices in response. As a result, we may decrease our price during the promotion, and after the promotion, our price may be the same or even lower than the original promotional price to offer you consistently low prices.

About the Pre-Order Price Guarantee: The Pre-order Price Guarantee applies to not-yet-released qualifying items.  Zona Shoppers.com’s price for not-yet-released items sometimes changes between the time the item is listed for sale and the time it is released and/or shipped.

For Physical Items:

Whenever you pre-order a physical item displaying the “Pre-order Price Guarantee” message on the product detail page, the price we charge when we ship it to you will be the lowest price offered on Zona Shoppers.com between the time you placed your order and the end of the day of the release date.

For Digital Downloads:

Whenever you pre-order digital content, the price we charge you will be the lowest price offered on Zona Shoppers.com between the time you place your order and the time the content is released.

Note: The Pre-order Price Guarantee applies only to items sold on Zona Shoppers.com, not on physical or POS stores. The Pre-order Price Guarantee does not apply to any products purchased at Zona Shoppers.com’s other sites.
